Waiver Agreement:
PLEASE READ THE WAVIER BELOW AND "SIGN"  (ALL RIDERS AGES 16-17 WITHOUT AN ADULT MUST HAVE PARENTAL APPROVAL.)

I understand that the 2024 Tour de South Brunswick Bike Ride (hereby known as TdSB) supporting the Education Foundation of South Brunswick Township, Inc., will be ridden on public roads and private property without specific oversight by any public safety authorities, and that biking in this manner is an inherently dangerous activity.  I acknowledge that participating in the TdSB could result in severe injury, disablement, or death.  Throughout my participation in the TdSB, I voluntarily, explicitly and fully assume all the risks of damage to my property, and all risks of direct or indirect injury of any kind to my person, no matter how severe, including disablement, or death (“casualty”) that affects me due to my actions or the actions of others, including without limitation, the Sponsors, Promoters and Managers of the TdSB, their Employees, Volunteers or Agents, or any other Participant in the TdSB (collectively “SPMEVAP”) whether or not the action by any SPMEVAP could be considered negligent.

I hereby agree to indemnify and hold the Tour de South Brunswick, the Education Foundation of South Brunswick Township, Inc., and SPMEVAP harmless against loss, cost or damage to me arising from a casualty during my participation in the TdSB, whether from collision with any fixed object or structure, pedestrian, vehicle, other participant, or due to equipment failure, inadequate safety warnings, or precautions, weather conditions, or any other cause or condition, and I shall have no cause of action in tort or any other claim against the Tour de South Brunswick or the Education Foundation of South Brunswick Township, Inc., or any SPMEVAP arising out of my participation in the TdSB.  This indemnification shall bind my personal representative and my heirs and no successor to me shall have any claim, nor be able to maintain any cause of action in tort or any other claim against any the TdSB or the Education Foundation of South Brunswick Township, Inc., or against SPMEVAP individually or collectively arising out my participation in the TdSB.

I attest that I have the requisite level of physical fitness to safely participate in the TdSB.  To my knowledge, I have no medical condition that would result in a casualty from my participation in the TdSB.  I will provide a copy of my health insurance coverage to the Manager or other designated representative of the TdSB. If I am injured and unable to seek emergency medical care I authorize that such care be obtained at my expense.  I agree to wear head protection gear and will use no type of head phone at any time while bike mounted.  I am responsible for providing a satisfactory bicycle and all repair tools and spare parts necessary to keep it in operating condition.  To avoid removal from the TdSB, I will abide by the rules of the TdSB and any specific instructions given to me by the Managers or other TdSB representatives that are deemed by them necessary for my safety.  I also grant permission to all of the foregoing to use any photographs or any other record of this event for legitimate purposes.  The TdSB is a rain or shine event.  No refunds due to cancelation for any reason.  The TdSB does not offer refunds on any registration fees.

I cannot unilaterally modify this indemnification or my obligations hereunder in any manner.

If Participant is a minor or acts in accordance with a legal guardian, the parent or guardian must sign and agree to the below:
I am the parent and/or legal guardian of Participant, and I hereby consent to his/her participation. I have read the foregoing agreement, and I hereby agree on behalf of myself and Participant to its terms.
